1. General 

These General Terms and Conditions (“Terms”) govern the offer, sale, and purchase of products through the website www.bemz.com and any purchases made from Bemz US Inc ("Bemz", "we", "us", or "our"). 

By placing an order on our website, you agree to be bound by these Terms. 

These Terms apply only to purchases made from Bemz US Inc by consumers located in the United States.

3. Eligibility to Purchase 

To place an order on our website, you must be at least 18 years old and legally capable of entering into a binding contract. 

 

We reserve the right to refuse or cancel orders that appear to be placed by resellers, businesses, or in violation of these Terms. 

 

4. Product Information 

We strive to ensure that product descriptions, images, and prices on our website are accurate. However, product colors and materials may vary depending on screen settings, images are for illustrative purposes only, and minor variations may occur due to production methods or materials.

 

We do not guarantee that the website will be free from errors at all times. 

 

5. Website disclaimer 
We do not guarantee that the website will operate uninterrupted, be error-free, or that defects will be corrected. We also do not guarantee that the website or its servers are free of viruses or other harmful components. We reserve the right to correct errors, inaccuracies, or omissions and to update information at any time without prior notice. 

 

6. Orders and Contract Formation 

By submitting an order, you make an offer to purchase the selected products. 

 

A binding contract is formed only when we send you an Order Confirmation by email. We reserve the right to decline or cancel an order prior to confirmation, in which case any payment received will be refunded. 

 

If, after having processed your order, we find that we cannot accept your order, we may cancel your order and refund the payment you have made related to the order. We currently accept orders for delivery within the United States. We recommend that you save the Order Confirmation sent from us for reference in any contacts with our Customer Service.  

 

7. Prices, Fees, and Payment 

All prices are shown in US dollars (USD). 

 

Prices do not include shipping fees, applicable sales tax, or customs duties (if applicable). These costs are displayed at checkout before you complete your order. 

 

Payments are processed securely by third-party payment providers. 

 

8. Free fabric samples 

We may offer a limited number of free fabric samples per customer. Additional samples may be subject to a shipping or handling fee. Details are available on our website. 

 

9. Discount codes  

We occasionally use discount codes as part of our marketing. These codes are valid only for limited periods and may be subject to certain conditions related to specific products, certain categories of products or for certain fabrics. To be able to use the discount code you must enter the code during the order process in the ‘Checkout’ on the website. Only one discount code can be used per order. Discount codes have no cash value and cannot be redeemed for cash, vouchers or similar.  

 

10. Delivery 

Delivery options, costs, and estimated delivery times are displayed during checkout and in our Help Center.

 

Delivery times are estimates only and may vary due to factors outside our control. 

 

If delivery requires collection from a carrier location, identification may be required. If the delivery cannot be made due to you not being available to receive the delivery or if you do not pick up your package, we reserve the right to charge you for our costs for return shipping and for our administration costs. 

 

On receiving your order, we recommend you open the box and check the products you have ordered straight away.  Any questions or issues can be raised with our Customer Support via the Help Center. 

 

11. Returns and Refunds (US Policy) 

We offer a voluntary return policy as described below. This policy is not a statutory right and may be subject to conditions. 

 

You may request a return within 14 days of receiving your products, unless an item is excluded from returns.  

 

To do this you must: 

  • Fill in the Return form you will find here 
  • Return the products by packing them unused, unwashed, well packaged and without damage, in its original packaging and in a maximum of one package, i.e. products that you have received in several packages must be returned to us in one package. We recommend that you return the products by using the shipping labels provided by us.  
  • Include the receipt along with the product(s).  
  • Ensure that the products are received by us within thirty days from the day you received the products.  
  • Items must be returned to the correct address, stated on the shipping label provided by us.  

 

Fabric ordered by the meter, curtains, and replacement seat cushions are not covered by the return policy and therefore can only be returned if it is defective 

 

12. Defective or Incorrect Products 

If you receive a defective or incorrect product, please contact Customer Service as soon as reasonably possible, via the Contact Form. 

In order for us to make an assessment of your complaint and the products, you must:  

1. With your complaint include a brief description of the defect and 4-6 photographs of the products where both the defect and the entire products is clearly visible.  

2. Include the order number or attach a copy of the Order Confirmation.  

3. Make sure that the products to be returned are well-packed.  

 

Remember that you are responsible for the package until it has been received by us, so save your receipt for the delivery of the package including information about shipping costs and tracking number if available.  

 

If a defect is confirmed, we will repair, replace, or refund the product at our discretion.  

 

If the faulty product was originally purchased from our Outlet, we cannot offer a replacement as our Outlet products are ‘unique items’ that have already been made.  We will offer a repair or partial/full refund.  

 

13. Warranty 

Certain products are covered by a three-year limited warranty from the date of delivery. 

 

The warranty covers defects in materials or workmanship under normal household use and does not cover normal wear and tear or damage caused by misuse. 

 

The warranty does not cover: 

1. General wear and tear and pilling over time 

2. Cuts, rips and breakages caused by improper use, pets, accidents, or incorrect installation. 

3. Fading/discolouration or shrinkage caused by lack of or incorrect care in accordance to the Bemz Care Guide 

4. Fading/discolouration caused by sunlight 

5. Natural changes in surface colour over time on wooden products as wood is a living material 

6. A warranty is not offered on repaired/replacement product where the warranty has already been used.  Instead this item will be covered by the standard product complaint process. 

 

14. Intellectual Property 

All content on the website, including text, images, trademarks, logos, and design, is owned by or licensed to Bemz US Inc or its affiliates. 

 

You may use the website for personal, non-commercial purposes only. 

 

15. Personal Data and Cookies 

We process personal information in accordance with our US Privacy Policy and US Cookie Policy, which form part of these Terms by reference. 

 

16. Accessibility 

Bemz is committed to digital accessibility. Information about our accessibility efforts is available in our Accessibility Statement

 

17. Force Majeure 

We will not be liable for any delay or failure to perform our obligations under these Terms and Conditions if such delay or failure results from events beyond our reasonable control. These events may include, but are not limited to, natural disasters, acts of government, labor disputes, transportation disruptions, supply chain interruptions, pandemics, power failures, or internet or telecommunications outages. 

 

18. Limitation of Liability 

Nothing in these Terms limits liability where such limitation is not permitted under applicable law. 

 

Our total liability related to any order is limited to the amount paid for that order. 

 

19. Governing Law and Venue 

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. 

 

Any disputes shall be resolved exclusively in the state or federal courts located in Delaware. 

 

20. Responsible Lobbying and Government Affairs

Bemz is committed to conducting business in a responsible, transparent, and ethical manner. Bemz does not engage in lobbying activities or seek to influence public policy or legislation in a manner that is inconsistent with the public interest or our sustainability commitments. Where Bemz participates in industry groups, trade associations, or collective initiatives, we aim to ensure that such participation aligns with our values, including environmental responsibility, social impact, and ethical business practices.

 

Bemz is committed to transparency in its approach to government affairs and to ensuring alignment with its sustainability and ethical business commitments.

 

21. #MyBemzStyle 

By responding with #MyBemzStyle you agree that Bemz may use any pictures that you have responded to with #MyBemzStyle (the Pictures) in Bemz marketing and/or advertising, including but not limited to social media, newsletters, catalogues, galleries on Bemz website, emails and in other customer communications. Moreover, you agree to that Bemz may use your social media handle in relation to which you have responded with #MyBemzStyle on www.bemz.com, in Bemz stores and on any of Bemz platforms, including but not limited to, Instagram, Facebook, LinkedIn, Pinterest and printed publications. Bemz may use, reproduce, distribute, combine with other materials, alter and/or edit the Pictures in any manner in its sole discretion. 

 

22. Changes to These Terms 

We may update these Terms from time to time. The version in effect at the time of your order will apply.
